WG Notes: [TEAMC] It doesn't really mean either "must not" or "should not". These words were used in WCAG 1.0 to correspond to Level 1 (must) or Level 2 (should) but this is not a conformance requirement in WCAG 2.0. It's just a recommendation that layout tables not be used but it is not a prohibition that they can't be used. The two sentences in the description are "Use of layout tables is not recommended. However, if layout tables are used, then the caption element is not recommended." This doesn't seem strong enough to me. If you are using layout tables, wouldn't it be incorrect to include a caption? If a table is used for layout, the caption element is not used."

Resolution: Layout tables may be used but we don't want to encourage their use. H39 has been modified to clarify the recommendation.
