Publishing Embedded and Royalty Free (RF) Assets

Use Case

John Audubon (pseudonym), an ornithologist and freelance photographer, wishes to publish a blog on birds around the world containing his journal posts (Blog) with an embedded window or widget containing his rare photographs and videos (Media Assets). Audubon hopes to educate readers, connect with other scientists and bird observers, and attract customers interested in licensing his Media Assets or buying his self-published book (Book) entitled Migratory Birds and Virus Transmission.

Audubon hosts his content on a content server, watermarks his Media Assets before publishing, and creates a clear copyright notice on his Blog, Media Assets and Book. Audubon takes the extra precaution of registering his contact information as the author and creator of the Blog and its Media Assets in a searchable database run by a copyright registry which provides him with unique identifiers for himself and each Media Asset. His book promotion copyright page include an ISBN number providing publisher contact information.

Audubon would like to include code snippets embedded in the HTML5 markup for each of his blog offerings. How can ODRL help Audubon build these expressions and prohibitions?


License Artefacts ODRL Policy
1) License for Blog

For his Blog posts (written text plus embedded window or widget containing Media Assets) Audubon decides to allow sharing of the blog page in its entirety for editorial purposes provided Audubon is given full attribution and specific links back to his blog contents.

• Share Blog page with Attribution - clicking on blog page will link back to Audubon’s Blog post

• Share Media Assets inside embedded window or widget - clicking on media asset will link to Media Asset RF license terms

• No Commercial Usage

• No Defamatory, Pornographic or Unlawful Matter

• Audubon reserves right to capture user information

• Audubon reserves right to provide advertising on his Blog page

• Audubon reserves right to provide in-image/video advertising within or on tool bar of Media Asset Embedding Window or Widget

• Audubon reserves right to remove Blog or Media Assets at any time

Permissions
  • Actions: To share the blog we can use reproduce
  • Constraints: To make sure the blog can only be embedded in recipient webpage, then we can use the deliveryChannel (with what value?)

Notes

  • missing is use of the content in a non-porn context (defamatory and unlawful are legal issues not covered by a machine policy language)
  • the right to provide advertising is not covered as he can just do that anyway
2) Royalty-Free (RF) license for Commercial Uses of Media Assets

For commercial uses of the Media Assets, Audubon would like to offer Royalty Free (RF) reproduction rights. Potential customers may identify Audubon by his watermark, unique identifier. and/or clicking on the embedded Media Assets where Audubon’s Terms of Service are expressed. If a user wishes to buy a non-watermarked RF license to reproduce one of his photographs or videos for commercial purposes such as advertising, promotions or merchandising, Audubon will provide a non-watermarked media asset for download upon acceptance of his Terms of Service and payment.

  • Photographs: Download under RF Model
  • Royalty Free license to reproduce media asset (identifier) for editorial reproduction only.
  • Licensor may not use media assets on Merchandise products such as postcards, calendars, posters, stationary items, paper products, mugs, photo or giclee prints, wallpaper, artwork, or apparel items.
  • Client Copyright Notice or Creator Attribution required.
  • File size 1600 x 1200 pixels under standard RF terms. For larger file sizes or additional licenses contact Audubon direct.
  • Licensee to pay Licensor US$100 per photographic media asset
  • Video: Play on Pay per click (CPM) under Streaming Model
  • Licensee to pay Licensor US$2.00 CPM payable monthly
  • Client Copyright Notice or Creator Attribution required
