This test is: declare variable $v as element(notWildCard, xs:untyped?)+ := <e/>; 1 and it is expected to succeed. But the initializer of the variable declaration produces a value that does not conform to the required type (wrong element name). So it is legitimate to raise a type error. Its also legitimate not to raise it, since the variable is never used.
Should be fixed in CVS.
