fn-node-name-23 calls fn:node-name() on a constructed PI. The comment states it would call it with the wrong arity (2 arguments), but it doesn't. I don't think this test should fail.
fn-node-name-23 doesn't have a comment of the type you mention, but fn-node-name-24 does. I've done a quick check, and don't believe that either of these test cases is in error. If you agree with the resolution of this bug report, then please close it.
