Some parts of the spec don't handle BOMs properly, which could result in incorrect sniffing of a resource.

Also, BOMs should be used to indicate the value of a charset parameter, when applicable/possible.

As I mentioned elsewhere, I'm not convinced we should change much to the status quo.
